Terms of Service

Bill Oxford retains full copyright of all photos and videos. Photography and video files may not be licensed, transferred, assigned, shared, or sold to any other person, business, Multiple Listing Service (MLS), platform, publication, or organization without the prior written consent of Bill Oxford, except as expressly permitted below.

A limited, non-exclusive license is granted to the Client and the Client’s real estate brokerage solely for the marketing of the specific property photographed, including use on MLS systems, real estate websites, and related marketing platforms customary to residential and commercial real estate listings. This license does not transfer ownership and automatically terminates upon the sale, withdrawal, or expiration of the listing unless otherwise agreed in writing.

The Client assumes full responsibility for the use, publication, distribution, and display of all delivered photos and videos. Bill Oxford shall not be liable for any claims, damages, losses, fines, penalties, or legal actions arising from the Client’s use of the images, including but not limited to claims involving copyright infringement, trademark infringement, misrepresentation, inaccurate property depiction, false advertising, or violations of MLS rules, state regulations, or third-party rights.

In accordance with California Assembly Bill 723 (AB 723), the Client is solely responsible for ensuring that any required disclosures related to digitally altered or AI-modified real estate images are properly made in MLS listings, advertisements, and marketing materials. Bill Oxford does not control how images are labeled, disclosed, or presented once delivered.

Images may not be materially altered, composited, manipulated, or used for artificial intelligence training, machine learning, generative AI systems, virtual staging beyond what was expressly delivered, or derivative works without the prior written consent of Bill Oxford. This includes, but is not limited to, sky replacement, object removal or addition, structural modification, or reuse of images for properties other than the one photographed.

The Client agrees to indemnify and hold harmless Bill Oxford from any and all claims, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from the use, alteration, AI application, or distribution of the photos and videos.
